Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and bWare Studios LLC ("bWare Studios", "we", "us") governing your use of the bWare Player Panel at panel.bware.studio, the bWare Admin Panel at admin.bware.studio, and related services (the "Services"). By accessing or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
The Services support our experiences on Roblox and our Discord community. They are not operated by, affiliated with, or endorsed by Roblox Corporation or Discord Inc. Your use of Roblox and Discord remains subject to their own terms, and nothing in these Terms overrides them.
1. Eligibility
You must be at least 13 years old, and old enough to hold a Discord and/or Roblox account under their terms, to use the Player Panel. If you are under the age of majority where you live, you confirm a parent or guardian has reviewed and agreed to these Terms on your behalf. The Admin Panel may be used only by staff expressly authorised by bWare Studios.
2. Accounts and sign-in
- You sign in with Discord and/or Roblox. You are responsible for the security of those accounts and for all activity under your bWare account.
- One bWare account per person. Each Discord or Roblox identity can be connected to only one bWare account; connecting an identity that already belongs to another account you own lets you merge the two accounts; a merge is permanent and deletes the other account.
- Creating additional accounts to evade a ban, restriction, or cooldown is prohibited and may result in permanent removal from our experiences and community.
- You must keep at least one identity connected. You may disconnect the other from your account page, subject to rate limits.
3. Ban appeals
- The Player Panel lets you see whether you are restricted from our Roblox experiences or banned from our Discord server and submit an appeal.
- Appeals are reviewed by our staff at their discretion. Submitting an appeal does not guarantee a review outcome, a response time, or that any restriction will be lifted. Decisions are final unless we choose to revisit them.
- You may have one open appeal per restriction at a time. After a denial you must wait the cooldown period shown in the Services before appealing again.
- Appeals must be truthful. False statements, harassment, threats, spam, or abusive content in an appeal may result in denial and further sanctions.
- Appeal text is stored and visible to our staff and may be posted to private staff channels on Discord.
4. Roleplay server owner tools
- If your connected Roblox account owns roleplay server listings in our experiences, the Services let you view their status and statistics and edit certain listing details.
- Content you publish through a listing (names, descriptions, rules) must comply with these Terms, the Roblox Community Standards, our in-experience rules, and applicable law. We may edit, hide, or remove any listing and revoke owner tools at any time, with or without notice.
- Server ownership, in-experience purchases, subscriptions and any benefits attached to them are governed by the rules of the relevant Roblox experience, not by these Terms. The Services do not sell anything and do not process payments.
- Statistics are provided for information only and may be delayed, incomplete, or inaccurate.
5. Acceptable use
You agree not to:
- access or attempt to access accounts, data, or areas of the Services you are not authorised to use, including the Admin Panel;
- probe, scan, or test the vulnerability of the Services, bypass rate limits or security measures, or interfere with their operation;
- use automated means (bots, scrapers) to access the Services except through interfaces we expressly provide;
- upload or submit unlawful, hateful, sexual, violent, harassing, defamatory, infringing, or otherwise objectionable content;
- impersonate any person, staff member, or entity, or misrepresent your affiliation;
- use the Services to evade moderation actions on Roblox, Discord, or our experiences;
- reverse engineer or copy the Services except as permitted by law.
6. Content and licence
You keep ownership of the content you submit (appeal text, listing details). You grant bWare Studios a worldwide, non-exclusive, royalty-free licence to store, display, reproduce and use that content for the purpose of operating, moderating and improving the Services and our experiences, for as long as we retain it under our Privacy Policy. You are responsible for having the rights to anything you submit.
The Services, including their software, design, text and trademarks (other than Roblox and Discord marks), are owned by bWare Studios or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable licence to use the Services for their intended purpose.
7. Moderation, suspension and termination
We may suspend, restrict, or terminate your access to the Services, our experiences, or our community at any time, with or without notice, for any reason, including a breach of these Terms or conduct we consider harmful. You may stop using the Services at any time and may request account deletion as described in the Privacy Policy. Sections that by their nature should survive (including 6, 8, 9, 10 and 12) survive termination.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. Ban status, server data and statistics come from third-party platforms and may be delayed or inaccurate. We do not warrant that any appeal will be granted.
Some jurisdictions do not allow the exclusion of certain warranties; in that case the above exclusions apply to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, bWare Studios and its owners, staff and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, virtual items, in-experience progress, or server benefits, arising out of or related to the Services, even if advised of the possibility. Our total liability for all claims relating to the Services will not exceed USD 100.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or the statutory rights of consumers in the EU, UK or elsewhere.
10. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless bWare Studios from claims, damages and reasonable costs (including legal fees) arising from your content, your use of the Services, or your breach of these Terms.
11. Third-party services
Sign-in and core functionality depend on Discord and Roblox. We are not responsible for their availability, changes to their APIs, or actions they take on your accounts. Their terms and privacy policies apply to your use of their platforms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. The state and federal courts located in Texas have exclusive jurisdiction over disputes, except that consumers may bring claims in the courts of their country of residence where the law requires. Before starting any formal proceeding, you agree to contact us at braden@bware.studio and attempt in good faith to resolve the dispute informally for at least 30 days.
13. Changes to the Services and these Terms
We may change, suspend or discontinue any part of the Services at any time. We may update these Terms; material changes will be announced in our Discord server and reflected in the "Last updated" date. Continued use after the effective date of a change means you accept the updated Terms.
14. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. Notices to you may be given through the Services or our Discord server.
